By downloading, installing, or using the Vivvi App, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
1. About Vivvi
Vivvi is a mobile application that allows users to record, upload, share, and discover short-form fashion and style video content. The App is available exclusively on iOS devices and is operated by the Vivvi Team ("we," "us," or "our").
Vivvi enables users to: record and share short fashion and style videos; interact with content through likes, comments, and follows; discover trending looks and personalized recommendations; and purchase in-app coins to boost the visibility of their videos.
2. Acceptance of Terms
By creating an account or otherwise using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Vivvi. If you are under the age of 13, you may not use Vivvi. If you are between 13 and 18, you represent that you have obtained parental or guardian consent to use the App.
3. User Accounts
To access certain features of Vivvi, you must create an account. When creating your account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access or breach
- Accept responsibility for all activities that occur under your account
You may delete your account at any time through the App's Settings. Upon deletion, your locally stored profile data and content will be removed, subject to applicable retention requirements.
4. User Conduct & Content Guidelines
You are solely responsible for all content you post on Vivvi. You represent and warrant that all content you upload is your own original work or that you have the necessary rights and permissions to share it.
You agree NOT to post, upload, or share content that:
- Violates any applicable law, regulation, or third-party rights
- Contains nudity, sexual content, violence, or graphic material
- Promotes harassment, hate speech, discrimination, or illegal activities
- Infringes on the intellectual property rights of any third party
- Is false, misleading, or deceptive
- Contains spam, unsolicited advertising, or commercial solicitation
- Impersonates any person, brand, or entity without authorization
- Exploits or endangers minors in any way
Violations of these guidelines may result in content removal, account suspension, or permanent termination without prior notice.
5. Content Moderation
All videos submitted for public sharing undergo an automated content review before becoming visible. We reserve the right to reject or remove content that violates our Community Guidelines or applicable laws, even if it has not been publicly posted yet. We may also remove content reported by other users or third parties if we determine it violates our policies.
6. Intellectual Property
You retain ownership of all video content, captions, and comments you create on Vivvi. By posting content, you grant Vivvi a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the App for the purpose of providing the service to you and other users.
All trademarks, logos, branding, software, and other materials associated with Vivvi are the property of Vivvi or its licensors. You may not use, copy, modify, or distribute any Vivvi intellectual property without prior written consent.
Using third-party music, audio, or other copyrighted material in your videos may be subject to separate licensing requirements. Vivvi does not grant you any rights to use third-party copyrighted content beyond what is required for the App's functionality. You are solely responsible for ensuring any music or content in your videos is properly licensed.
7. In-App Purchases & Coins
Vivvi offers in-app coin packages that can be purchased through Apple's In-App Purchase system. All purchases are subject to Apple's App Store Terms of Service.
- Purchases: Coins are non-refundable unless otherwise required by law. Refund requests must be directed to Apple.
- Coins: Coins can be used to access the Boost feature to promote your video content. Coin balances have no cash value and cannot be exchanged for real currency.
- Boost Feature: Using coins for Boost does not guarantee any specific increase in video views or engagement. Estimated uplift figures are for reference only and depend on content quality, timing, and other factors.
- Account Deletion: Unused coins are forfeited upon account deletion and are non-transferable.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, secure, or error-free
- The App will meet your specific requirements or expectations
- Any content, information, or results obtained through the App will be accurate or reliable
- Any errors or defects in the App will be corrected
- The Boost feature will produce any guaranteed level of visibility or engagement
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIVVI, ITS DEVELOPERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the App
- Any content obtained from the App or through user interactions
- Unauthorized access, alteration, or destruction of your data or content
- Technical failures, errors, or interruptions in the App
- Any Boost purchases or coin transactions
- Any conduct or content of any third party on the App
IN ANY CASE, THE TOTAL LIABILITY OF VIVVI FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless Vivvi and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or access to the App
- Your violation of these Terms of Service
- Your violation of any third-party right, including intellectual property, privacy, or publicity rights
- Any content you upload, post, or share through the App
- Your interaction with other users of the App
11. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms of Service or our Community Guidelines
- Posting prohibited, illegal, or harmful content
- Attempting to gain unauthorized access to the App or other user accounts
- Engaging in fraudulent or deceptive activity, including IAP abuse
- Harassment, abuse, or threats directed at other users or Vivvi staff
- Repeated copyright or intellectual property infringement
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
12. Modifications to the Terms
We reserve the right to modify these Terms of Service at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you through the App or via email. Your continued use of the App after any modifications constitutes your acceptance of the revised terms. If you do not agree to the modified terms, you must stop using the App.
13. Governing Law & Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association.
